Ashley St. Clair filed a paternity lawsuit against Elon Musk last Friday, also requesting sole legal custody of their newborn child, according to court documents obtained by Page Six. The 26-year-old conservative activist claimed she started a relationship with the 53-year-old CEO of SpaceX in May 2023 and that they conceived the child around January 2nd and 3rd, 2024. While the exact birth date and the full name of the baby were redacted in the documentation, it was revealed that the child’s initial is “R.”

St. Clair stated in her petition that she is sure Musk is the father, as “she did not have intimate relations with any other man during the time the child was conceived.” Therefore, she has requested the court to order a genetic test to confirm paternity. To support her case, St. Clair submitted a series of text messages exchanged with the entrepreneur, in which she claims Musk acknowledged the child as his. According to the documents, after sending him a photo from the hospital with the baby, he replied, “I look forward to seeing you and him this weekend.”

The lawsuit also mentions other compromising messages. On November 24th, 2024, Musk allegedly wrote to her: “I want to hit you again,” and on February 2nd, 2025, he added: “Well, we have a legion of children to make.” Although St. Clair stated that she does not seek child support at this time, she requested a temporary financial support order for the baby. Regarding custody, she has asked to be solely responsible for all legal decisions related to her child.

“I am the only parent making decisions for R.S.C. I schedule and take him to all his medical appointments,” she argued. “I am the only one who cares for him daily. I feed him, bathe him, and ensure all his physical and emotional needs are met.”

Similarly, St. Clair stated that Musk was not present at the baby’s birth, despite being invited, and that he has only seen his child three times: two brief encounters in New York in September 2021 and a 30-minute visit in Austin, Texas, on November 30th, 2024. “The defendant has never asked to see our child on any other occasion, has never communicated with me about him unless I contacted him first, never asked for photos, nor showed any interest after medical appointments,” she declared.

St. Clair publicly revealed the existence of her alleged child with Musk on X (formerly Twitter) on February 14th: “Five months ago, I welcomed a new baby into the world. Elon Musk is the father.” She claimed she had initially kept the matter private but decided to speak out after the media began to inquire.

The news has sparked reactions, including from Vivian Wilson, Musk’s daughter, who sarcastically commented on TikTok: “If I had a nickel for every time I found out I have half-siblings on Reddit, I’d have two nickels… which isn’t a lot, but it’s weird that it happened twice, right?”

It should be noted that this lawsuit adds to Musk’s current legal troubles, as he is also facing a custody dispute over the three children he has with singer Grimes: X Æ A-Xii (4 years), Techno Mechanicus (2 years), and Exa Dark Sideræl (3 years). Recently, Grimes publicly accused Musk of ignoring medical emergencies concerning one of their children and of not responding to her calls, messages, or emails. To date, Elon Musk has not issued any statements regarding the paternity lawsuit or the accusations from Grimes.
